1. Acceptance of Terms

By accessing or using forwarding.email ("Service"), operated by MappedBy Inc ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

forwarding.email provides email forwarding and alias services, allowing users to create dedicated email addresses that forward incoming messages to their personal email. The Service includes email notifications, spam filtering, and related features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 18 years old to use this Service.

4. Acceptable Use

You agree NOT to use the Service for:

• Any illegal activities or to facilitate illegal activities
• Sending spam, unsolicited marketing, or bulk emails
• Harassment, threats, or abuse of any person
• Fraud, impersonation, or deceptive practices
• Distributing malware, viruses, or harmful content
• Phishing or attempting to obtain sensitive information
• Violating any applicable laws or regulations
• Interfering with or disrupting the Service

We reserve the right to suspend or terminate accounts that violate these terms without refund.

5. Prepaid Service & Payment Terms

FORWARDING.EMAIL IS A PREPAID SERVICE. You must purchase credits in advance to use the Service. Credits are deducted as you receive emails and maintain active email aliases. New accounts receive $0.50 in complimentary credits.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. By purchasing credits, you acknowledge and agree that:

• All credit purchases are final and cannot be refunded under any circumstances
• Credits have no cash value and cannot be exchanged for cash
• Credits are non-transferable between accounts
• Unused credits do not expire but are forfeited upon account termination for Terms violations
• You waive any right to dispute or charge back any purchase made on this Service

CHARGEBACK POLICY: If you initiate a chargeback or payment dispute with your bank or credit card company for any purchase made on forwarding.email, your account will be immediately suspended and may be permanently terminated. We reserve the right to pursue collection of any amounts owed, including chargeback fees, through appropriate legal channels. Initiating a chargeback constitutes a breach of these Terms.

We reserve the right to modify pricing at any time with reasonable notice. Price changes will not affect credits already purchased. If you do not agree with price changes, you may stop purchasing additional credits and use your remaining balance.

6. Email Aliases

Email aliases provided through the Service are licensed, not sold. We reserve the right to reclaim aliases that are inactive for extended periods or used in violation of these terms. Alias availability is not guaranteed. You may not register aliases that infringe trademarks, impersonate others, or are offensive in nature.

7. Email Content

You are solely responsible for the content of emails sent to your aliases. We are not responsible for any email content, including spam, malware, or offensive material that may be sent to your aliases. We provide spam filtering on a best-effort basis but do not guarantee filtering accuracy.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance or due to factors beyond our control. We are not liable for any damages resulting from service interruptions or delayed email delivery.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPPEDBY INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS. WE ARE NOT LIABLE FOR LOST, DELAYED, OR UNDELIVERED EMAILS.

10. Indemnification

You agree to indemnify and hold harmless MappedBy Inc and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Modifications

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or through the Service.

12. Termination

You may terminate your account at any time through the dashboard settings. We may terminate or suspend your account for violation of these terms, suspicious activity, fraud, or for any other reason with or without notice.

Upon termination: Your right to use the Service ceases immediately. Any remaining credit balance is forfeited and will not be refunded. Your email alias(es) will be released and may be reassigned to other users. Email history may be deleted. This applies whether termination is initiated by you or by us.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of competent jurisdiction located in Toronto, Ontario, Canada.
